Scope of application

“Lev naturanda” rents out the agreed parking space (camper van, van, motorcycle) or rental accommodation (holiday apartment, tent) with the specified facilities to the guest for the agreed length of stay. These General Terms and Conditions (hereinafter referred to as “GTC”) apply to rental contracts for the rental of pitches, rental accommodation, outbuildings, leisure facilities and all other services provided to the guest in this context. The guest will be informed in detail by the operators about the use of the site/rental property before and upon arrival. The guest must observe these instructions during their stay.

Conclusion and amendment of the contract:

• The prices are currently available on the websites of “Lev naturanda” and linked to the booking program (www.belegungskalender.com). Other price lists are not valid and only provide a rough guide (brochures and websites of third parties).
• Lev naturanda” will not increase prices after the conclusion of the contract. The prices indicated in the booking confirmation sent by ‘Lev naturanda’ shall apply. Verbal price agreements shall not be valid. In the event of an adjustment/change, a written notification of change must be provided in a timely manner. However, price adjustments during the current calendar year are not excluded. An extension can be booked on site with the operators of “Lev naturanda”, subject to availability.
• The booking calendar is checked and updated daily by the operators of “Lev naturanda”. However, the times of the review and processing may vary, so that updates to the booking calendar may only be visible on the following day. Available booking dates are marked in green. Times that are already occupied are marked in red. The guest offers to enter into a rental agreement with Lev naturanda for the specified period and for the reported number of persons. If the accommodation is available, the guest will receive a booking confirmation from Lev naturanda by email or, in the case of short-term bookings, in person on site. The booking confirmation will be accompanied by a copy of the GTC in PDF format or, in the event of a personal booking confirmation, in written form. The rental contract is concluded when the guest makes the (down) payment of the invoice or when they enter the camping/glamping site, whichever occurs earlier. If there is an overlap of booking requests, the guest will receive a “busy” message from the operators instead of a booking confirmation by email, and thus the opportunity to book an alternative date.
• Only the persons specified in the reservation are entitled to use the accommodation facilities. The maximum occupancy for the respective accommodation facility must not be exceeded. Children of any age count as a full person.

• The respective offers of “Lev naturanda” cannot be rented by persons under the age of 18. Children and adolescents are not allowed to stay on the entire premises of “Lev naturanda” without their respective legal guardians and/or supervisors.
• When booking pitches, the size of the vehicle must be taken into account and the managers of “Lev naturanda” must be informed in advance and in good time, as only a limited number of spaces for large vehicles or caravans can be offered on the property. This can be arranged by telephone.
• Offers made by “Lev naturanda” for the conclusion of a rental contract are subject to change and non-binding. “Lev naturanda” may, at its sole discretion, refuse to conclude a rental contract with a guest.

Payments and due dates

• Upon reservation / receipt of the booking confirmation, the stated deposit of 50% is to be paid within 5 working days by bank transfer.
• The remaining amount for the entire period is to be paid in advance no later than 4 weeks before the start of the stay. There will be no refunds for early departure.
• For short-term bookings (30 days or less) / on-site bookings, the entire accommodation price including booked additional options (sauna, hot tub, fishing trip, curling, etc.) is due immediately. In case of early departure, the fees will not be reimbursed under any circumstances.
• If the deposit or the balance is not paid in due time, the booking may be immediately canceled. In this case, the guest will be informed once by e-mail about the consequences of the outstanding payment and will be given the opportunity to remedy the situation within three days. If the payment has still not been received by the end of this period, the booking will be immediately canceled by the operators of “Lev naturanda”. In no event will the 25% deposit already paid be reimbursed.
• The guest may only assert rights of set-off and retention if the underlying counterclaims are undisputed or have been legally established.
• The following are accepted on site: bank transfers, EC and Maestro cards, Swish

Arrival and departure

• In order to comply with the registration formalities, each guest shall register with the operators with a valid identity card before entering the “Lev naturanda” area. Upon request, this data will be passed on to authorities or municipal offices. These data are also collected for the safety of the guests in the event of incidents requiring medical treatment or search operations. The operators are able to organize assistance quickly and easily if all personal data are available. (The data are stored in accordance with the statutory retention periods until the purpose of the data collection no longer applies. See also the data protection declaration on the “Lev naturanda” websites.)
• Guests can plan their arrival time individually but are kindly requested to communicate it in advance to the managers of “Lev naturanda” in order to ensure the timely availability of the accommodation. This approach allows the managers to schedule the final cleaning times and to welcome each guest warmly and personally.
• Guests should vacate the pitch or accommodation by 11:00 (AM). Any deviations must be discussed in advance with the operators of “Lev naturanda”.
• Upon termination of the lease, the guest shall vacate the accommodation and return it in a proper condition. The condition existing at the time of handover of the rented property shall be restored, whereby any deterioration caused by the contractual use shall be irrelevant.

Pets

• Bringing pets (dog / cat) is explicitly allowed, but requires notification to the operators during the booking process. Depending on the type of accommodation, only a limited number of pets can be brought. This is due to the size and nature of the respective accommodation.
• An additional fee is payable for each animal brought along, which is due to a more thorough final cleaning. The fee will be shown in the booking confirmation. There are no additional fees for pets traveling in a camper van – i.e. when booking a pitch – as no final cleaning is required in this case.
• Dogs must be kept on a lead at all times on the entire premises – also out of consideration for other dog owners who are holidaying on the premises at the same time.
• Any damage or soiling caused by pets must be removed by the pet owner immediately. The guest must ensure that his dog remains on his own pitch.

Rental accommodation

• The rental accommodation is as described on the “Lev naturanda” website.
• Lev naturanda provides the bed linen/sleeping bags. A rental fee for this is already included in the rental price of the respective accommodation.
• Lev naturanda’s operators will carry out the final cleaning of the rental accommodation themselves. This does not include cleaning the dishes or taking out the rubbish. Guests are kindly requested to clean the accommodation and take the rubbish to the recycling station and dispose of it in the clearly marked containers. The final cleaning includes changing bed linen/sleeping bags (depending on the type of rental accommodation), cleaning all appliances, shelves, windows, floors, curtains and blankets. The guest will be charged a fee for this, which is indicated on the websites of “Lev naturanda” and in the booking confirmation.

Pitches

• Provided that the availability and size of the vehicle permit it, the pitch can be freely chosen in a designated area at “Lev naturanda”.
• A minimum distance of 4 meters (legally required fire protection) to each neighboring vehicle / tent must be observed.
• Enclosures and digging of trenches are not permitted on the pitches.
• We kindly ask you to refrain from using foils and awning carpets in order to preserve and maintain the given natural areas in the best possible way.
• There is no legal entitlement to the supply of electricity. Electricity can only be provided if a connection is possible and will only be charged by “Lev naturanda” in addition to the stated energy flat rate.

Compensation and liability

• The guest assumes liability, in particular towards third parties,
  • in the event of improper electrical connections of their own vehicle
  • in the event of damage caused by their gas equipment
  • In the event of damage to objects, facilities, nature and the environment of the “Lev naturanda” camping/glamping site
  • In the event of blockages caused by disposal in toilets
• Use of the “Lev naturanda” camping/glamping site and its facilities is at the user’s own risk.
• The use of the additional offers of “Lev naturanda”, i.e. boat rental, curling and fishing trips, is at your own risk. “Lev naturanda” only provides life jackets for the boat rental and relevant information on how to behave for the respective activities booked. We recommend taking out accident insurance. The respective rental equipment is to be treated with care and caution so that subsequent guests can also enjoy it.
• The camping/glamping site “Lev naturanda” is located directly on the lake “Mensträsket” and is not far from forests and moors. Children are to be made aware of the dangers and supervised accordingly. “Lev naturanda” does not accept any liability for injuries and accidents as well as lost or damaged property.
• Smoking (tobacco products or smoke substitutes) is not allowed in the buildings and rental accommodations. Please use the outdoor areas for this purpose and dispose of any resulting remains in the designated waste containers. In case of non-compliance, a flat fee of at least €130 will be charged for ventilation, cleaning and loss of rent.
• Any complaints regarding the pitch or the rental accommodation shall be immediately reported by the guest to the operators of “Lev naturanda”. Any assertion of defects shall be excluded if they have not been immediately reported to the operators of “Lev naturanda” within 3 days of the guest’s stay. The operators shall be granted a reasonable period of time to rectify the defect (remedy).

Withdrawal / cancellation / transfer

• In case of the traveller withdrawing from / cancelling the travel contract prior to the start of the trip, “Lev naturanda” shall be entitled to claim the following flat-rate compensation for withdrawal. It is expressly recommended to take out a travel cancellation insurance.
  
  • For cancellations up to 90 days before arrival, 50% of the total invoice amount is to be paid (the deposit paid will be retained in full),
  • up to 30 days before arrival 80%,
  • after that 100%.
• “Lev naturanda” shall be entitled to effect extraordinary withdrawal from the contract for a materially justifiable cause, e.g. if force majeure or other circumstances for which the operators are not responsible make it impossible to fulfil the contract or if “Lev naturanda” has justified reasons to assume that the use of the service may jeopardize the smooth business operations, security or public reputation without this being attributable to the sphere of control or organization of “Lev naturanda”.
• “Lev naturanda” shall be entitled to terminate the contract without notice for good cause (Section 569 of the German Civil Code) in order to enforce the site rules and terms and conditions if:
  • the guest insults or endangers other guests or staff during their stay,
  • seriously disturbs the peace and order,
  • expresses hostility or discriminatory behavior,
  • willfully destroys, damages or removes the inventory / equipment of the site,
  • is under the influence of illegal drugs,
  • is excessively intoxicated with alcohol or
  • behaves in a manner that is contrary to the contract.

In these cases, the guest shall not be entitled to a claim for reimbursement of the paid / pro-rata fee, unless the guest proves that “Lev naturanda” has suffered less damage than the payment made.

• The guest may request that a third party enter into the rights and obligations of the travel contract instead of the guest up until the start of the trip (transfer of contract in accordance with § 651 b BGB). In the event of a transfer of contract, the incoming substitute guest is liable as the joint debtor for the travel price and any additional costs incurred by his or her entry. The transfer of contract must be requested in writing and, in order to ensure short processing times, by email to info@lev-naturanda.com.

Miscellaneous

• After the winter season, there may be occasional noise disturbances due to renovation and refurbishment work. These are limited to the times between 10 a.m. and 12 p.m. and between 2 p.m. and 5 p.m. They do not constitute grounds for a reduction in payment. This also includes possible acute events throughout the year or an acute disruption of the supply to the site or the rental accommodation, to which a repair or replacement must be carried out immediately.

General provisions

• Any deviating and/or supplementary agreements require the explicit written (email) confirmation of the operators of “Lev naturanda”.
• We reserve the right to correct mistakes, printing errors and miscalculations.
• Should one or more of the above provisions be invalid, this shall not affect the validity of the remaining provisions.
